Welcome to Varient, a Shopify app developed and operated by Hipwerk GmbH. Varient provides AI-powered conversion optimization tools, including audits and actionable suggestions for product pages. By using our services, you agree to be bound by these Terms & Conditions.
2. Acceptance of Terms
By accessing or using Varient, you agree to these terms and our Privacy Policy. These terms may be updated from time to time. Continued use of the platform indicates your acceptance of any changes.
3. Subscription and Pricing
Varient is offered via a subscription model with several pricing plans. Please refer to our Pricing page for current plans and features. Subscriptions renew monthly until canceled. We reserve the right to modify pricing with notice.
4. Fair Use and Unlimited Plan Abuse
The "Unlimited" plan is subject to fair use. Any use of automated tools, bots, or scripts to run audits, or attempts to extract data in bulk, will be considered abuse. We reserve the right to throttle, suspend, or terminate accounts that show signs of abuse or unusually high usage that exceeds reasonable and intended use by a human user.
We monitor usage patterns to ensure platform integrity and performance for all users. Hipwerk GmbH reserves the right to define what constitutes fair use and may update these definitions as needed.
5. Intellectual Property
All content, code, and underlying technology used by Varient are the intellectual property of Hipwerk GmbH. You retain ownership of your store's data but grant us a limited license to process it to deliver services. AI-generated content is provided as-is and for informational purposes only.
6. Data Usage and Privacy
We process store data (e.g., images, titles, descriptions, metadata) to provide personalized recommendations. For more information on how we handle your data, see our Privacy Policy.
7. Warranties and Disclaimers
Varient is provided "as is." We do not guarantee the accuracy, reliability, or completeness of any AI-generated content. Use of our service is at your own risk. We do not guarantee uninterrupted access or error-free performance.
8. Limitation of Liability
To the maximum extent permitted by law, Hipwerk GmbH shall not be liable for any indirect, incidental, or consequential damages. Our total liability for any claim arising out of or relating to these terms or the use of Varient is limited to the amount paid by you to us in the preceding 12 months.
9. Termination
We reserve the right to suspend or terminate your account at any time if you breach these terms or abuse the platform. You may cancel your subscription at any time through your Shopify admin panel. Termination does not entitle you to a refund unless required by law.
10. Governing Law
These terms are governed by the laws of Switzerland. All disputes shall be resolved in the courts of Zürich, Switzerland.
